The topics of data protection and data security often cause uncertainty and raise questions when using online services. We aim to counter this uncertainty with as much transparency as possible.

Data protection is therefore important to us, and we process your data only in accordance with legal requirements. In this privacy policy, we explain how we collect or otherwise process personal data and what rights you have in this regard. Personal data refers to all information relating to an identified or identifiable person.

2. General Principles

Processing of Personal Data

We primarily process personal data that we collect during the operation of our website or other applications, or that we obtain in the course of our business relationship with our customers and other business partners.

We collect your personal data primarily directly from you. In some cases, we may also receive personal data about you from third parties. These data categories may include:

  • Information from publicly accessible sources (e.g., media, internet)

  • Information from public registers (e.g., commercial register, debt collection register, land register)

  • Information related to official or judicial proceedings

  • Information about your professional functions and activities

  • Information about you in correspondence and meetings with third parties

  • Credit information (if we engage in personal transactions with you)

  • Information from people in your environment who provide us with information so we can conclude or fulfil contracts with you (e.g., references, your address for deliveries, powers of attorney, compliance with legal requirements, information from banks, insurers, distribution partners, and other business partners)

  • Information from media and the internet about you (where necessary, such as for job applications, press reviews, marketing, sales, etc.)

  • Data related to the use of the website (e.g., IP address, MAC address of the smartphone or computer, information about your device and settings, cookies, date and time of the visit, pages and content accessed, functions used, referring websites, location information)

Purposes and Legal Bases of Data Processing

We only process your data for specific purposes and only in cases permitted by law. Below, you will find the individual data processing operations on our website, along with the purposes and legal bases for processing.

Possible legal bases include:

  • Your consent;

  • The performance of a contract or pre-contractual measures;

  • Compliance with legal obligations;

  • Our legitimate interests, provided your interests or fundamental rights do not override them;

  • The protection of vital interests of you or another person or the performance of a task in the public interest;

  • Other relevant legal bases.

For each processing operation, you will find an indication of the legal basis.

If you have given us your consent to process your personal data for specific purposes, we process your data within the scope of this consent unless we have another legal basis. You can revoke your consent at any time. Data processing that has already taken place is not affected by this revocation.

Data Disclosure

In the course of providing our services and operating our website, we may need to engage third-party service providers. In such cases, we may entrust third parties with processing your personal data. We contractually ensure that these third parties comply with data protection requirements. In some cases, we are also required to disclose your data to authorities or other third parties.

We only disclose your personal data if one of the following conditions is met:

  • Your consent has been obtained;

  • There is a legal obligation;

  • It is necessary for the enforcement of our rights, especially the enforcement of claims arising from the contractual relationship;

  • It is necessary for the performance of a contract or pre-contractual measures;

  • We have a legitimate interest, and your contrary interests do not prevail;

  • Another legal permission exists.

In some cases, personal data may be transferred to companies abroad as part of order processing. These companies are subject to the same data protection obligations as we are. If the level of data protection in the country where the data is transferred does not match that of Switzerland or the European Union, we contractually ensure that the same protection as in Switzerland or the European Union is guaranteed. This may be achieved through standard data protection clauses of the European Commission or a supervisory authority, or through approved and enforceable codes of conduct along with binding and enforceable obligations of the recipient or approved certification mechanisms together with binding and enforceable obligations of the recipient.

If data is transferred to a company in the USA, we ensure that the company is certified under the Swiss or EU-US Privacy Shield Agreement, ensuring that the data protection level of Switzerland or the EU is adhered to. If there is no certification, we obtain the necessary guarantees contractually.

Retention Period

We only retain personal data for as long as it is necessary to fulfil the purposes for which the data was collected. We retain contract data for longer periods due to legal requirements. Such retention obligations arise from regulations related to registration, accounting, and tax laws. According to these regulations, business communications, concluded contracts, and booking records must be retained for up to 10 years. If we no longer need such data from you for the provision of services, the data will be locked. In this case, we will only use the data for accounting and tax purposes.

Data Security

We take data security very seriously and use appropriate technical and organisational security measures to protect your personal data from accidental or intentional manipulation, loss, destruction, or unauthorised access by third parties. We continuously improve our security measures according to technological developments.

On our website, we use SSL (Secure Socket Layer) technology in connection with the highest encryption level supported by your browser. You can recognise an encrypted page of our website by the closed lock icon in your browser's status bar.

Obligation to Provide Certain Personal Data

In some cases, you may be required to provide certain personal data in order to establish business relationships. This includes personal data that is necessary for establishing and performing a business relationship and fulfilling the corresponding contractual obligations. Without such data, we are generally unable to process a contract with you (or the entity or person you represent).

In most cases, our website cannot be used if certain information necessary for ensuring data traffic (such as the IP address) is not disclosed.

Profiling

In some cases, your personal data may be automatically processed to evaluate certain personal aspects (known as profiling). Profiling is mainly used by us to inform and advise you in a targeted manner about certain services or products. To this end, we use evaluation tools that allow us to communicate in a needs-based manner and take appropriate advertising measures, including market and opinion research.

Your Rights

You have the right to request information from us about what personal data we hold about you. You can also request the correction of inaccurate data or request the deletion of personal data, provided there are no legal retention obligations or legal reasons that allow the processing. Additionally, you may, under certain circumstances, request the restriction of the processing of your personal data or object to the processing. You also have the right to retrieve the data you have provided to us (right to data portability). You have the right to receive the data in a commonly used file format. You have already been informed about the possibility of withdrawing your consent, as well as your right to withdraw consent at any time during relevant data processing operations.

Please note that the exercise of your rights may be subject to legal limitations. We reserve the right to assert these, for example, if we are legally required to retain or process certain data, have an overriding interest (to the extent we are entitled to rely on it), or need the data to assert claims. Additionally, exercising your rights may conflict with contractual agreements and result in corresponding consequences, such as early termination of the contract or costs. Where not already contractually regulated, we will inform you in advance.

Exercising your rights requires proof of your identity (e.g., by providing a copy of your ID card if your identity cannot otherwise be verified). If any costs arise for you, we will inform you in advance.

If you are affected by the processing of personal data, you have the right to assert your rights through the courts or to lodge a complaint with the competent supervisory authority. In Switzerland, the competent supervisory authority is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).

Changes

We reserve the right to change this privacy policy at any time without prior notice. The version published on our website at the time of your visit applies.
